MINING LAW

Congolese mining law is governed primarily by the Mining Code and its Mining Regulations, which were revised in 2018 to better adapt to economic and environmental realities. Here are some key points:

 

1. Classification of resources : Deposits are classified into mines (mineral substances not classified as quarries) and quarries (building materials, ceramics, etc.)

 

2. Conditions of exploitation : Artisanal exploitation is reserved for Congolese adults, while industrial exploitation is open to legal entities, local or foreign, under certain conditions.

 

3. Taxation and transparency : The 2018 reform introduced measures to improve transparency in resource management and optimize tax revenues.

 

4. Social and environmental responsibility : Mining companies must respect obligations towards local communities and the environment.
